The offer and sale of products on the website www.findis.it are governed by these Terms of Sale, which apply to every proposal, order and purchase order confirmation of products.

Confirmation of the order by the Customer constitutes acceptance of these terms and conditions of sale, strictly reserved for the customer “consumer” as defined by ‘art. 3 of the Consumer Code (Legislative Decree 6 September 2005, n. 206 as amended by Legislative Decree 21 February 2014, n. 21 implementing the EU Directive “Consumers”), namely:

– Any natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity.

If you do not fall into the category of “consumers” as defined above, please refrain from entering into commercial transactions on this site, making it clear that they will not be considered by us.

As a reminder, registration on the site and the ability to order is prohibited for anyone under the age of 18.

1. Mode of purchase

1.1. The General Conditions of Sale govern all distance sales of Products on the Site.
1.2. Through the Site, the Seller sells the Products exclusively to its end users who are “consumers”, i.e. natural persons acting for purposes not related to their commercial, entrepreneurial, handicraft or professional activity, if any (hereinafter the “Customer”).
1.3. The sale of Products on the Site is intended exclusively for individuals who have completed, in Italy, 18 years of age and, abroad, the minimum age required by applicable law for the purchase of alcoholic beverages. By also placing the purchase order, the Customer represents and warrants that the same Customer and, where different from the latter, the eventual recipient of the Products, are of age and possess the age required by the applicable law in force for the purchase of alcoholic beverages.
1.4. The sale of Products on the Site refers exclusively to the countries indicated in the list of shipping countries on the relevant page of the Site that can be reached through the Homepage.
1.5. The Seller reserves the right to provide a maximum limit of Products, or types of Products, that may be purchased on the Site.
1.6. The Seller, therefore, reserves the right not to process orders from parties other than the “consumer” and/or minors, from countries not included among those listed as shipping countries or, in any case, orders that do not conform to its commercial policy.
1.7. The General Conditions of Sale do not regulate the sale of goods or the provision of services by parties other than the Seller, even if they are present on the Site through links, banners or other forms of connection. It is the Customer’s responsibility to check the Terms of Sale before placing orders and purchasing goods and services from parties other than the Seller. The latter is therefore not responsible for the sale of goods and/or provision of services by third parties and/or the conclusion of agreements between the Customer and third parties.

2. Product purchase order

2.1. To order one or more Products on the Site, the Customer must select the Products he/she intends to purchase and add them to the shopping cart. After finishing the selection of the chosen Products, the Customer must continue with the checkout at the shopping cart web page, fill out the order form in electronic format, according to the relevant instructions, and transmit it to the Seller.
2.2. The languages available for the conclusion of the purchase order are those indicated, for each country, in the section on shipping countries reachable through the Homepage of the Site.
2.3. The purchase order for the Products may be placed by the Customer either through his/her personal account, if registered on the Site, or through the guest user mode, in which case he/she shall provide the personal information required to proceed with the fulfillment of the order.
2.4. The order form contains a reference to the General Terms and Conditions of Sale, as well as a summary of information on the main characteristics of each Product ordered and its price (including all applicable taxes or duties), the means of payment accepted and the method of delivery of the Products purchased, the shipping and delivery costs, the conditions for exercising the right of withdrawal and the manner and timeframe for returning the Products purchased.
2.5. Before proceeding to the purchase of Products by transmitting the order form, the Customer is required to read carefully the General Conditions of Sale, which he/she may also print, store or make a copy of for personal use. The Customer, by submitting the order form, declares that he/she has understood and approved the contents of the order form, as well as accepted the General Conditions of Sale and Use of the Site while, failing this, the purchase order cannot be proceeded with.
2.6. Before submitting the purchase order form, the Customer may check the details of the order, as well as identify and correct any data entry errors.
2.7. The submission of the order form by the Customer implies for the latter the obligation to pay the price indicated in the order.
2.8. The presence of the Products on the Site shall be understood as an invitation to offer by the Seller. The sending of the purchase order by the Customer to the Seller shall count as a proposal to purchase the individual Products covered by the order.
2.9. Upon receipt of the purchase order, the Seller will send the Customer, by e-mail, a receipt of the purchase order, which will contain a summary of the General Conditions of Sale, information on the essential characteristics of the Products and a detailed indication of the price (including all applicable taxes or duties), the means of payment, the conditions and procedures for exercising the right of withdrawal and delivery costs. This e-mail is an automatic confirmation of receipt of the order and does not imply acceptance by the Seller of the Customer’s purchase order.
2.10. The Customer’s purchase order shall be deemed to have been accepted by the Seller with the latter’s sending of the e-mail confirming that the Products ordered have been shipped.
2.11. The Seller reserves the right not to accept purchase orders. This may occur, for example, in case of unavailability of the Products or incomplete or incorrect orders, which do not give sufficient guarantees of solvency or which are contrary to the Seller’s commercial policy and/or the General Conditions of Sale. In these cases, the Seller will promptly and in any case within 30 days from the transmission of the order to the Seller, inform the Customer by e-mail that the contract is not concluded and that the Seller has not carried out the purchase order. In the event that the Customer has already submitted the order form and paid the price, the Seller will refund the amount paid.
2.12. The order form will be filed in the Seller’s database for the period of time necessary to process orders and in any case in accordance with the terms of the law. The Customer, if registered on the Site, will be able to view the orders placed by accessing his personal account and consulting the appropriate section of the Site. The Customer who has made a purchase as a “guest” user may check the orders placed by contacting Customer Service as indicated in paragraph 11 “Customer Service” below.

3. Characteristics of products

3.1. Only original Products distributed by Findis srl are marketed on the Site
3.2. The essential characteristics of the Products are presented on the Site within each Product tab. However, the images and colors of the Products on the Site may not correspond to the real ones due to the effect of the Internet browser and/or monitor used.
3.3. Each Product is sold on the Site together with its identification tag, which is an integral part of the Product itself.

4. Payments

4.1. The prices of the Products shown on the Site are expressed in euros (€) and are already inclusive of all applicable taxes and duties. On the other hand, Product prices do not include shipping and delivery costs, which will be clearly indicated at the beginning of the Product purchase process.
4.2. The prices of the Products may be subject to change. The Customer undertakes, therefore, to check the final sale price before sending the relevant order form.
4.3. Methods of payment can be found at the Payments page of the Site, as well as indicated in the individual purchase order form, and are an integral part of the General Conditions of Sale.
4.4. The price for the purchase of the Products and the shipping costs, as indicated in the order form, will be charged after the purchase order is sent by the Customer and before the Products are shipped by the Seller.
4.5. In the event that payment by STRIPE is chosen, financial information will be forwarded, via encrypted protocol, to banks or companies that provide the relevant remote electronic payment services, without third parties being able, in any way, to access it. Moreover, this information will never be used by the Seller except to complete the procedures relating to the purchase for which it is conferred and to issue the relevant refunds in the event of any returns of Products, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on the Site.
4.6. If the Product is delivered to a country within the European Union, the Product sold should not be subject to any customs clearance costs, such as import taxes and/or duties.
In the event, however, of delivery to a country outside the European Union, the Products sold may be subject to customs clearance costs, such as import taxes and/or duties, payable upon arrival of the Product at the country of delivery. Customs clearance costs cannot be predicted in advance by the Seller and are, in any case, fully borne by the Customer.
For further information, the Customer may contact the customs office in the country of delivery of the Product.

5. Time and manner of order fulfillment

Orders are processed Monday through Friday. Therefore, orders placed from Friday to Sunday evening are processed starting Monday.

Findis.it shall deliver the products selected and ordered by the Client by COURIER. Delivery times in Italy, according to the provisions of art. 6 of Legislative Decree no. 206/2005, are ON AVERAGE 24 – 72 hours from the time the customer is sent the email of completed order. For Sicily, Sardinia, Italian islands, Calabria, dislocated areas, Venice and inconvenient areas delivery may take an additional 24/48 hours, on average.

Orders received by noon will be processed on the same day. For orders received after noon, the order will be processed the following business day.

The recipient will receive an email from the courier that allows them to track the shipment in real time. Findis Ltd. is not responsible for any delays in the delivery of packages due to inconveniences caused by the courier company, such as strikes, heavy traffic, problem areas, emergencies, miscellaneous.
Waybill: If the shipment cannot be delivered to the specified address, the driver will leave a notice notifying the recipient of the waybill. This document, which is called a “passing notice,” contains key information such as the shipment number and contact information for the Reference Location. Depending on the courier chosen, redelivery options may vary: new delivery attempt, or delivery to a pickup point, or delivery to a different address.
Please do not accept packages that are not intact or whose packaging condition including tape is not intact.

6. Prices and details of products

The order note constitutes the valid document for tax purposes.
All sales prices of the Products on the Site are expressed in Euros and include VAT and any other taxes. The prices applied are those indicated on the Site at the time of the purchase order by the Customer.

The prices of the products published from time to time cancel and replace the previous ones and are subject to the actual availability of the products. The characteristics of the products published correspond to those communicated by the respective manufacturers. Findis srl assumes no responsibility regarding the truthfulness and completeness of such information.

7. Methods of payment

Findis Ltd. offers its Clients the ability to pay with:

STRIPE. No extra charge. Pay with your account. Credit is immediate and there is no need to send payment accounting. It is possible to pay with your credit card by going through the STRIPE site. For the customer the transaction is free of charge.

Bank transfer.

Please use the order number as the reason for your order. Your order will not be shipped until the funds appear to have been transferred into our bank account.

8. Transportation

The goods travel on behalf and at the risk of the buyer, Findis Ltd. will therefore not be responsible for any delays or damages resulting from transportation. In the event that the package arrives visibly damaged REJECT the package. The delivery terms indicated by Findis srl refer to products in stock and are to be considered non-binding since the same may be modified by Findis srl in case of actual needs. Findis srl reserves the right to deliver products related to the same order in several deliveries without further charge to the Client. Special delivery terms and conditions shall be agreed upon in advance by email or telephone between the Client and Findis srl and accepted by both parties.

9. Offers and promotions

Any special offers or promotions proposed by Findis srl are valid until the expiration of the same or, until the products covered by the promotion are sold out. During promotions with percentage discounts, shipping costs are always understood to be net of the discounts applied.

10. Shipping

Shipping costs in Italy are:
euro 10 for orders up to euro 100
euro 5 for orders up to euro 200
zero for orders over euro 200

For shipments to Europe and Extra-EU, costs are to be determined by country.

11. Product warranties

Findis srl guarantees only the material integrity of the products at the time of delivery. Any defects must be reported by the Client, under penalty of forfeiture, no later than 15 (fifteen) days from the date of delivery. The Client is entitled to the replacement of damaged products upon return of the same, the return shipment is at the expense of the buyer, excluding the Client’s right to compensation for any damage, even further. Findis srl does not provide any additional warranty on the products with respect to that provided by the individual manufacturers. Without prejudice to cases of willful misconduct or gross negligence on the part of Findis srl, it is agreed that Findis srl’s liability shall not exceed the price of the products purchased by the Client under dispute.

12. Right of withdrawal

Pursuant to Legislative Decree 206/2005, the Customer has the right to withdraw from the contract and return the products ordered within the term of 14 (fourteen) working days from receipt of the products. The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with acknowledgment of receipt to FINDIS SRL – Registered Office in Milan, via Ugo Bassi 3, within the terms provided by law. The Customer may not exercise the right of withdrawal with respect to customized or bulk products. Refunds will be made as quickly as possible, and in any case within 30 days from the date on which Findis srl is informed, in the manner described above, of the Client’s exercise of the right of withdrawal. The Client is required within 14 working days of the exercise of the right of withdrawal, to ship the returned Products to Findis srl’s address, with traceable shipment and expenses borne by the Client.

13. Returns and refunds

Findis Ltd. has designed a very simple product return and replacement procedure to make the online shopping experience enjoyable even if the purchase does not fully satisfy. It is possible to return any product purchased on findis.co.uk within 2 working days from the date of delivery.

Here’s how:
1) The customer must make sure that the products are in the same condition as they were received, unopened, damaged and unused.

2) Must prepare the package well sealed, specifying the order code, personal data and e-mail address. The package should be sent by courier or mail to the following address:

In case of loss or failure to return the goods, the responsibility will be fully borne by the Customer.

3) The Client will receive a confirmation email when Findis srl accepts the return, within 3 working days from the date of delivery to the warehouse. Please remember that only correctly returned products will be refunded.

4) Within 5 working days, in case it is possible to make product replacement, according to the goods in stock, Findis srl will take charge of sending the replacement goods back to the Customer, by courier. 14. Refunds

The customer’s return will be accepted within 5 working days from the date of delivery of the package to our warehouse by sending the customer a confirmation email.

Indicative times for refunds are:

• Bank transfer: the Bank will make the refund within 3 working days after the Customer receives the confirmation e-mail.
• PayPal/Credit Card: the refund will be visible within 24 hours after the Customer receives the confirmation e-mail.

15. Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree September 6, 2005 No. 206 on distance contracts and Legislative Decree April 9, 2003 No. 70 on certain aspects concerning electronic commerce. In case of disputes between www.findis.it and each end user, arising from the General Conditions of Sale, the competent court of jurisdiction is BRESCIA.

16. Editing and updating

The General Terms and Conditions of Sale shall also be amended from time to time in consideration of any regulatory changes. The new General Terms and Conditions of Sale will be effective from the date of publication on www.findis.it.
